TERMS AND CONDITIONS APP NUTRISA
These Terms and Conditions apply to the use of the application (hereinafter "App") Promociones Inmobiliarias Naturistas, S.A. de C.V, "(hereinafter "NUTRISA"). Please read carefully the Legal Terms and Conditions governing access and use by users (the "User" or "Users") of the NUTRISA App and/or affiliates and/or subsidiaries and/or any page and/or application of the brands belonging to NUTRISA, since access and use of the App attributes the condition of User thereof and constitutes the understanding and acceptance of the Legal Terms and Conditions set forth herein.
This App can be visited by any User freely and free of charge subject to these Legal Terms and Conditions.
The content of this App is intended to inform the User about general information and/or benefits of our loyalty program related to NUTRISA, which does not imply or guarantee that the information contained herein can meet the requirements of precision, detail or accuracy required in the judgment of the User. In such virtue, the content is of informative nature, reason why the interpretation is personal of each User.
The User declares under oath to be of legal age, for which you must enter your date of birth in the registration process of the App. In the event that the User lies in their data at the time of registering on the App and it turns out that is under age, NUTRISA shall have the right to cancel your registration, losing all rights to which it may be entitled, for having misrepresented data at the time of registration.
NUTRISA assumes no liability whatsoever, derived from the fact that the information available in this App is not accurate or complete and reserves the right to modify the content of the App at any time and without prior notice to the User, including these Legal Terms and Conditions. The modifications made will take effect immediately upon their incorporation in the App.
The information of this App is in relation to the products marketed exclusively in the United Mexican States, being considered as an App of purchase, benefits and rewards where the Users can acquire the same within the national territory. Therefore, the information contained in the App is applicable within the territory of the United Mexican States and NUTRISA does not guarantee that it complies with the laws of other countries, so the User is solely responsible for complying with local laws that apply if you enter the App from anywhere outside the United Mexican States.
By accessing this App, the User agrees and acknowledges that NUTRISA is not responsible at any time for the lack of communication, interruption, failure or disabling of the App for reasons not attributable to NUTRISA; as well as not be liable for any damage or injury, including but not limited to, by technical failures of any kind, including damage to personal computer equipment, cell phone, tablet and / or any device used by users to access the App or to experience or appreciate the materials related to it, by unauthorized human intervention, delays, distortions or interference in telephone or computer transmissions or other errors of any kind, whether human, electronic or mechanical. In the same sense, NUTRISA shall have no liability for any loss caused by viruses that may infect your computer or other property by reason of using, entering or downloading any material from this App. If the User chooses to download use of the App will always be at your own risk and any misuse or incorrect use of the information will be solely your responsibility.
All information such as but not limited to: Images, Videos, Texts, Trademarks, Products, Commercial Ads, Domain Names and Designs, Reports, Policies, Press Releases, History of Nutrisa and other similar (referred to herein as "Information") contained in this App, may be owned by NUTRISA, its owners and / or licensees, being therefore protected by international conventions and Mexican legislation on industrial and intellectual property.
Nothing contained in this App should be construed as granting any license to use or right to use the Information displayed, and any use, reproduction in whole or in part of the Information or any content contained herein is prohibited.
The User undertakes to use the App, its contents and/or services diligently and in accordance with these Legal Terms and Conditions; as well as with the law, morality, public order and good customs.
NUTRISA reserves the absolute right to deny or withdraw access to the App and/or the services contained herein, at any time and without prior notice to the User who does not comply with the provisions of these Legal Terms and Conditions.
NUTRISA also reserves the right to restrict, terminate or terminate the entry to this App, the User who attempts to deliberately damage or alter the App or any of its sections, spoil, modify or prevent the legitimate operation of the same, for what constitutes a violation of Federal and Local Laws, NUTRISA reserves the right to act by Civil and/or Criminal and/or any other, in order to claim the repair of the damage and the corresponding compensation for Damages and Damages.
ACCUMULATION OF POINTS
- The accumulation of points is conditional upon presentation of the barcode in store.
- All tickets prior to the first login cannot be accumulated.
- All products generate points accumulation
- An email will be sent when the customer's points are about to expire.
- The percentage of accumulation of points will be defined by the level in the app in which the customer is located.
- Stores located within Tiendas Liverpool do not participate in the accumulation of points.
Exceptions to the accumulation and redemption of points
- It is necessary to wait one hour (60 minutes) from the last accumulation to accumulate points again on the same day, and a maximum of only three (03) accumulations per day will be allowed.
- Only a maximum of two (02) points redemptions per day will be allowed.
- Under no circumstances shall there be retroactive accumulation of points.
- Nutrisa is not responsible for failures in the physical store system.
- Purchases paid with points are not applicable to accumulate points.
- Accumulation by showing the virtual card on purchases at Nutrisa physical stores.
- Points are not transferable or redeemable for another user.
- Points have no cash value and are not redeemable for cash or other goods other than those specified.
- If the card is not shown before payment, the purchase will not be valid for points accumulation.
Redemption of Points
The user will be able to redeem his points in purchases both in App and in physical store. The value of each point is $1.00 (One peso 00/100 M.N.).
Restrictions on the redemption of points
- Products purchased with points may not be billed for.
- Products purchased with points are non-exchangeable and/or non-returnable.
- Under no circumstances shall there be retroactive accumulation of points.
- The user will be able to combine payment methods with his or her points in app.
- Purchases made with combined payment methods that include points cannot be billed.
APP LEVELS
Benefits and restrictions by app level are described below.
Bronze:
- Accumulation of 02% (two percent) of points in all purchases.
- Birthday gift active during the birthday month registered in the app.
- Free conito for first purchase.
- Personalization of gift cards.
- To maintain the level it is necessary to register at least $100.00 (One hundred pesos 00/100 M.N.) of purchase per month.
Silver:
- Accumulation of 05% (five percent) of points on all purchases.
- Birthday gift active during the birthday month registered in the app.
- Personalization of gift cards.
- Anniversary bonus points.
- Priority access to launches.
- Exclusive promotions .
- To maintain the level it is necessary to register at least $200.00 (Two hundred pesos 00/100 M.N.) of purchase per month.
Gold:
- Accumulation of 08% (eight percent) of points in all purchases.
- Birthday gift active during the birthday month registered in the app.
- Personalization of gift cards.
- Anniversary bonus points.
- Priority access to launches.
- Exclusive promotions.
- Exclusive catalog of products to redeem.
- To maintain the level it is necessary to register at least $400.00 (Four hundred pesos 00/100 M.N.) of purchase per month.
BENEFITS:
FREE CONITO FOR FIRST PURCHASE
When you make your first purchase with a minimum value of $35.00 (thirty-five pesos 00/100 M.N.) you will receive a complimentary soft cone with a natural or seasonal flavor. This benefit will be activated once the first purchase is made through the app. Does not apply with other promotions and/or discount cards. Subject to store availability. Does not include extra topping or fresh fruit, will be charged separately at menu price. Valid at all branches except Liverpool stores, Fábricas de Francia, Museums or Amusement Parks. The validity period to validate the benefit will be 07 (seven) calendar days from the activation of the coupon.
BIRTHDAY ICE CREAM
Attend during the month of your birthday (date that the user registers in the App) and get a free soft ice cream, natural or seasonal flavor. Does not apply with other promotions and/or discount cards.
Subject to availability in store. (To make it valid the user must show his/her official ID to redeem the benefit, as well as having generated a minimum purchase ticket of $35.00 (thirty-five pesos 00/100 M.N.), in the last 60 calendar days prior to the birthday month registered through the app). Does not include extra topping or fresh fruit, will be charged separately at menu price. Valid at all branches except Liverpool stores, Fábricas de Francia, Museums or Amusement Parks, from the first day of the birthday month (date of registration in the Nutrisa APP) and until the end of the month. Once the birthday ice cream has been redeemed, the user will not be able to change his/her birthday date in the app.
APP USAGE POLICY
This section sets forth the features, requirements and minimum standards for use the app (the "App Usage Policies"):
- The User may not use the app for illegal activities or in violation of the laws of any jurisdiction.
- The User may not use the app to incite, in any way, to violence or generate threatening content to third parties or to the property of third parties or to the safety of any person or property.
- The User may not use the app for advertising, promotional or other inappropriate activities.
- The User may not use the app in a way that violates the rights of third parties, including intellectual property rights, privacy and personal data protection.
- The User may not use at any time mechanisms that introduce viruses or codes to the programs or computer systems of the app and Nutrisa and its subcontractors.
- The User may not circumvent, remove, alter, disable, interfere with or circumvent the app's protections.
- The User may not access the app through mechanisms not authorized by Nutrisa, including automated means, such as "robots", "spiders" or "offline readers" or perform activities that damage, disable, overload, impair and/or allow unauthorized access to the app, the assets of Nutrisa, the Suppliers or their subcontractors, as well as the accounts of other Users.
- The User may not modify the app, or any other elements related to the app, in any way.
- You may not use the Intellectual Property of the App (as such term is defined below) or any other information related to the App in any manner whatsoever, except as expressly set forth in these Terms and Conditions.
- The User may not use the app to collect information from other Users, nor may the User at any time use the app.
- The User may not use the app, except as expressly set forth these Terms and Conditions.
- The User may only perform legal and legitimate transactions through the app.
- The User shall refrain from impersonating the identity of natural or legal persons.
- The User shall indemnify and hold Nutrisa harmless from any liability, penalty or obligation resulting from the violation of these App Usage Policies.
PROCESSING OF YOUR PERSONAL DATA
Our Privacy Notice describes how we collect, use and share your personal data. By using the App, you tacitly consent to our Privacy Notice, which forms part of these Terms and Conditions. We encourage you to carefully read our Privacy Notice before using the App. We also inform you that PROMOCIONES INMOBILIARIAS NATURISTAS, S.A. DE C.V. (hereinafter the "Responsible Party") with address at Calzada San Bartolo Naucalpan, No. 360, Colonia Argentina Poniente, Alcaldía Miguel Hidalgo, Mexico City, C.P.11230, is responsible for the processing of the personal data you provide us, which will be protected in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, its Regulations and other applicable regulations (hereinafter jointly referred to as the "Applicable Law"). Therefore, you acknowledge that the Responsible has made available to you the corresponding Privacy Notice, which can be consulted at any time within the App. Furthermore, you state that you have been informed in accordance with the Applicable Law about the identity and address of the Controller, the personal data that the Controller will collect, the primary and secondary purposes of the processing of such data, the means offered to limit the use or disclosure of your data and/or revoke your consent, as well as to exercise your rights of access, rectification, cancellation and opposition (ARCO), and the transfers of your data, if necessary for the fulfillment of the obligations arising from these Terms and Conditions. We reserve the right to change our Privacy Notice at any time. Changes will be effective when posted on the App. It is the user's responsibility to periodically review the Privacy Notice to be aware of changes.
FOR THE PURCHASE OF PRODUCTS THROUGH THE APP
By using the app or purchasing any of our Products, the user ("You" or the "User", indistinctly) agrees, for all legal purposes, to be subject to and be bound by these Terms and Conditions, as set forth below.

By accepting these Terms and Conditions the User authorizes to receive notifications from Nutrisa through various means, including email, text message, automatic notifications, notices or messages in the app, or any other electronic or physical means determined by Nutrisa.
MODIFICATION OF TERMS AND CONDITIONS
Nutrisa reserves the right to modify these Terms and Conditions at any time. Any modification to these Terms and Conditions will be effective 5 (five) days after it is published in the app in the Terms and Conditions section or, where appropriate, at the time the User receives an email notifying such modification. In any case, the User's continued use of the app, once such modification is published in accordance with the above, constitutes the User's full acceptance the modifications made from time to time to these Terms and Conditions, without any notification of such modification to the User being necessary, the foregoing constituting full express and binding acceptance by the User of these Terms and Conditions, as well as their respective modifications.
APPLICABLE LAW AND JURISDICTION
Nutrisa and the User agree that any dispute relating to these Terms and Conditions, the Account and/or the app shall be governed by the applicable federal laws of the United Mexican States, and Nutrisa and the User expressly submit to the jurisdiction of the competent courts of Mexico City in the United Mexican States and the User expressly waives any other jurisdiction that for any reason may apply.
